Online Copyright Infringement

Has a copyright infringer stolen your online content? Walton Law Firm can help. Online copyright infringement is the number one legal problem we deal with daily.

Common Scenario: A website owner works hard to build a top-notch website full of quality content. Perhaps the website owner invests resources drafting well-written text or producing high quality product photographs or sales videos. Then one day the website owner discovers that a copyright infringer has published that same original content on the infringer’s own website.

This scenario occurs often, but thankfully copyright owners have options. An Internet law attorney at Walton Law Firm can guide you through those options.

How we deal with online copyright infringement:

Sending Cease and Desist (C&D) letters

    • A C&D letter is a formal letter sent to a copyright infringer demanding that he stop the infringing activity. Sending a C&D letter is a cost-effective way to notify a copyright infringer that he is breaking the law. And when a C&D letter is sent by a law firm focused on Internet copyright law, it sends a clear message to the infringer that you are serious.

Filing DMCA complaints with Online Service Providers and ISPs

    • Under the Digital Millennium Copyright Act (DMCA) of 1998, online service providers must promptly take down content if a copyright owner alleges it infringes their copyright. This process is commonly referred to as a DMCA 512 takedown notice. This notice may be served upon many online service providers, such as web hosting companies and search engines. Walton Law Firm can advise you of the benefits and risks of serving a DMCA 512 takedown notice, and handle the procedure for you.

    Negotiating licenses and financial settlements

    • We often conduct settlement negotiations with a copyright infringer before filing a lawsuit. Negotiating a license or financial settlement is usually much faster and less expensive than litigating a copyright infringement case in court.

    Filing copyright infringement lawsuits

    • In some cases a fair settlement can not be reached with a copyright infringer without filing a lawsuit. When the situation calls for it, we won’t hesitate to take it to court.
